The Croatian Academy of Sciences and Arts organizes a lecture series titled Science in Focus, aimed at presenting, in an engaging and accessible way, the research results of its scientific-research and museum-gallery units, which are unique in Croatia. On Tuesday, April 28, 2026, starting at 8:30 a.m., at the Institute for Scientific and Artistic Work of the Croatian Academy of Sciences and Arts in Split (Milesi Palace), a lecture on the topic “Contracts for Nautical Berths” will be delivered by Adriana V. Padovan, PhD, Senior Research Advisor at the Adriatic Institute of the Croatian Academy of Sciences and Arts. The lecture is organized in cooperation with the Faculty of Law of the University of Split and is also part of the curriculum for students of the integrated undergraduate and graduate law program, within the course Maritime and Transport Law.
The lecture addresses the legal framework adopted by the Maritime Code of the Republic of Croatia, which regulates the berth contract as a new nominate contract under Croatian law. It analyzes the provisions of the Maritime Code concerning contracts for nautical berths introduced by the 2019 Amendments to the Maritime Code. The definition of a berth contract will be presented, its main characteristics explained, and its essential elements, obligations, and liabilities of the contracting parties analyzed, along with other important legal issues related to such contracts. Special attention will be given to the background of the legislative proposal introducing specific provisions on berth contracts into the Maritime Code, including details on the preparatory work that preceded this new legal solution.
The legislative proposal emerged as one of the outcomes of the scientific research project titled “Development of a Modern Legal and Insurance Framework for Croatian Marinas – Enhancing Competitiveness, Safety, Security, and Marine Environmental Protection (DELICROMAR),” carried out at the Adriatic Institute of the Croatian Academy of Sciences and Arts from 2016 to 2019 and funded by the Croatian Science Foundation. The legal regulation of nautical berth contracts in the Republic of Croatia represents an important step toward greater legal certainty in the field of nautical tourism, which, as an economic sector, is of strategic importance to the Republic of Croatia.
