The 5th HGK Nautical Days – the Congress of Croatian Nautical Industry and Tourism are taking place in Biograd from October 20th to 24th 2021. The event is held during the Biograd Boat Show which celebrates its 23rd year and traditionally takes place at the Marina Kornati Ilirija d.d.
Vesna Skorupan Wolff, PhD, and Associate Professor Adriana Vincenca Padovan, PhD, participated at the Session of the Marina Association of the Croatian Chamber of Economy and at the Round Table on Marina Operator Liability under a Berthing Contract with a Focus on Damages Resulting from Fire held on 21st October 2021.
The Round Table was prompted by the recent judicial practice and the latest 2019 Amendments to the Maritime Code regarding berthing contracts. Mićo Ljubenko, Attorney-at-Law, presented the review of the relevant judicial practice on marina operator liability in the event of a fire. Vesna Skorupan Wolff, PhD, in her presentation on marina operator liability under a berthing contract thoroughly analysed the question whether a vessel at berth represents a dangerous object and in this regard whether marina operators are strictly liable for damage to a vessel at berth.
Associate Professor Adriana Vincenca Padovan, PhD, discussed the issue of inapplicability of the legislative provisions regulating the warehousing contracts to marina operator berthing contracts. Finally, she argued in favour of the standardization of berthing contract models for Croatian Marinas.
